Terms of service

Last updated: October 2026

1. Scope

These General Terms and Conditions apply to all orders placed by consumers and entrepreneurs through our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.

An entrepreneur is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its trade, business or independent professional activity.

2. Contracting Party

The purchase contract is concluded with:

Omnixol UG (haftungsbeschränkt)
Bergstraße 10
86453 Dasing
Germany

Commercial Register: Local Court of Augsburg
HRB 37767

Email: info@omnixol.de

Further company information can be found in our Legal Notice.

3. Conclusion of the Contract

The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.

You may initially place the desired products in the shopping cart without obligation. Before submitting your binding order, you may review and amend your entries at any time using the correction options provided during the ordering process.

By clicking the order button that completes the ordering process, you submit a binding offer to purchase the goods contained in the shopping cart.

After receipt of your order, you will generally receive an automatic confirmation by email. Unless this confirmation expressly states that your order has already been accepted, it merely confirms that we have received your order.

The purchase contract is concluded when we accept your order by sending an express order confirmation or by dispatching the ordered goods to you.

4. Contract Language and Storage of the Contract

The contract language available for the conclusion of the contract is German.

After conclusion of the contract, we store the contract text in accordance with the applicable legal requirements. You will receive the essential order details and contractual information in connection with your order and/or by email.

You may access and save our General Terms and Conditions at any time on our website.

If you use a customer account, you can view the orders stored in connection with your customer account there.

5. Prices and Shipping Costs

Prices displayed to consumers in our online shop are final prices and include statutory VAT and other price components.

Where offers are expressly directed at entrepreneurs and prices are shown as net prices, this will be indicated accordingly.

Shipping costs may apply in addition to the price of the goods.

The shipping costs applicable to your order will be displayed in the shopping cart or checkout before you submit your order.

Further information can be found under Shipping & Payment.

6. Delivery

Delivery is made to the shipping destinations offered in the online shop or checkout and to the delivery address provided by the customer.

Orders are generally shipped with DHL. Where necessary, other suitable shipping carriers may also be used.

The applicable delivery time is stated in the online shop, on the product page or during the ordering process.

If different delivery times apply to individual products, this will be indicated separately for the respective product.

Partial deliveries are permitted insofar as they are reasonable for the customer. The customer will not incur any additional shipping costs where the partial delivery is initiated by us.

7. Payment Methods

The payment methods currently available for your order will be displayed during the ordering process or in the checkout.

The payment methods available may depend in particular on the destination country, order value and the requirements of the respective payment service provider.

Where an external payment service provider is used, its additional contractual terms and terms of use may apply.

The invoice amount is due in accordance with the payment method selected by you.

8. Retention of Title

The goods delivered remain our property until payment has been made in full.

For entrepreneurs, the following additionally applies: We retain title to the goods until all claims arising from the ongoing business relationship have been settled in full.

9. Right of Withdrawal for Consumers

Consumers generally have a statutory right of withdrawal in the case of distance contracts.

Details concerning the requirements, deadlines, exercise and consequences of withdrawal are set out in our separate Withdrawal Policy.

You will also find the Model Withdrawal Form there.

The right of withdrawal does not apply or may expire early where the statutory requirements for a corresponding exception are met.

10. Liability for Defects

The statutory rights relating to defects apply.

For consumers, the regular limitation period for claims relating to defects in goods is generally two years from delivery of the goods, unless otherwise provided by law.

In relation to entrepreneurs, the statutory provisions apply unless a valid differing agreement has been made.

If the customer is a merchant within the meaning of the German Commercial Code (Handelsgesetzbuch – HGB), the statutory duties of inspection and notification of defects remain unaffected.

11. Liability

We are liable without limitation for damage resulting from an intentional or grossly negligent breach of duty by us, our legal representatives or vicarious agents.

We are also liable without limitation for damage arising from injury to life, body or health, within the scope of an expressly assumed guarantee and under the mandatory provisions of product liability law.

In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the damage that is typical for the contract and foreseeable at the time the contract is concluded.

Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the contracting party may regularly rely.

In all other respects, liability for slight negligence is excluded to the extent permitted by law.

12. Consumer Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final Provisions for Entrepreneurs

If the customer is an entrepreneur, all legal relationships between us and the customer are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), insofar as its application can be validly excluded.

If the customer is a merchant, a legal entity under public law or a special fund under public law, our registered office shall – to the extent permitted by law – be the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and the customer.
